The following terms govern the warranty references marked with an asterisk (*) throughout this website, including our Lifetime Structural Shell Warranty and the Pebble Tec® / Pebble Sheen® interior finish. These terms are a summary for informational purposes. The warranty provisions of your fully executed Customer Contract with LIV Pools govern in all respects and, in the event of any conflict, the executed Customer Contract controls. All warranties described below are expressly in lieu of all other warranties and guarantees, express or implied, including any warranties of merchantability or fitness for a particular purpose.
1. Lifetime Structural Shell Warranty
LIV Pools (Florida License CPC1459998) warrants the gunite/concrete pool shell installed under contract against structural failure caused by a defect in LIV Pools’ workmanship.
- Duration. This warranty extends for as long as the original owner owns the property at which the pool was installed (“lifetime”), beginning on the date of substantial completion (i.e., the date a certificate of completion or its equivalent is issued by the building department), and is subject to the limitations of applicable Florida law.
- Scope. “Structural failure” means a defect in the structural integrity of the concrete shell that renders the pool unable to hold water, caused directly by LIV Pools’ failure to perform the work in a workmanlike manner.
- Sole remedy. LIV Pools’ sole obligation is, at its election, to repair or replace the affected portion of the shell at its own expense or the expense of its subcontractors. LIV Pools is not responsible for the cost of water, chemicals, decking, finishes, landscaping, or restoration of surrounding improvements disturbed in the course of any structural repair.
Not covered under the structural shell warranty: hairline cracks; surface checking; cosmetic, plaster, or finish cracks; minor cracks caused by structural damage, soil movement, settlement, expansion, or any condition not directly caused by LIV Pools’ workmanship; and any of the general exclusions in Section 8 below.
2. Pebble Tec® / Pebble Sheen® Interior Finish Warranty
The interior pebble finish is covered by a manufacturer-backed lifetime warranty issued by Pebble Technology, Inc. and applied by a licensed applicator (Pebble Pros, LLC). LIV Pools facilitates this warranty; it is governed by the manufacturer’s own warranty terms, which include the following:
- Material (lifetime). The pebble aggregate material is warranted against failure for the lifetime of the finish from the date of installation, and is covered only when installed by a licensed Pebble Tec®/Pebble Sheen® applicator. The material warranty covers aggregate only.
- Labor. Labor associated with the finish is warranted by the applicator (Pebble Pros, LLC) and is subject to the same terms as the material warranty.
- Color, tone & texture variation is normal and not a defect. Natural stone and application techniques produce variations in color, tone, shade, and appearance. These variations are a characteristic of a natural pebble finish and are not considered a failure.
- Some loss of stone is expected. Minor loss of surface stone, especially in a new installation, is normal and is not considered a defect.
- Seashell materials. Some finishes contain seashell materials (such as abalone and mother-of-pearl). Because of the nature of these natural materials and water chemistry beyond anyone’s control, the manufacturer does not guarantee the lasting integrity of shell material against degradation or loss of color.
- Conditions. The finish warranty is valid only when the pool is properly maintained (see Section 9), tested weekly by a reputable service using a computerized analysis, with records retained, and is valid only after the applicator has been paid in full. It is non-transferable and valid only to the first owner.
Not covered: etching, pitting, scaling, staining, or discoloration resulting from improper water chemistry or chemical maintenance; marcite or finish discoloration; efflorescence; and the general exclusions in Section 8.
3. Natural Stone Finishes (Travertine, Marble, Pavers, Coping & Decking)
Where the owner selects a natural stone product for coping, decking, water features, or any other surface, the owner understands and agrees:
- The coloration, patterns, grain, veining, and finish of natural stone will vary, may not match perfectly piece to piece, and will change and weather over time.
- LIV Pools does not guarantee the cut, color, grain, texture, or finish of natural stone, including how it ages.
- Variations in tone and appearance, efflorescence, fading, chalking, surface checking, and natural weathering are inherent characteristics of natural stone and are not considered defects.
- Any 3D renderings, samples, or showroom displays are conceptual only and cannot be relied upon as to exact features, colors, textures, dimensions, or finishes of the installed product.
4. Florida Weather, Acts of God & Force Majeure
No warranty offered by LIV Pools covers damage caused by weather, the elements, or any event outside LIV Pools’ control. Without limitation, the following are excluded from all warranties:
- Named or unnamed storms, hurricanes, tropical storms, and tropical systems;
- Flooding, storm surge, rising or standing groundwater, and ground saturation;
- High winds, tornadoes, lightning, hail, and freeze or frost damage;
- Earth movement, soil settlement, expansion, subsidence, and sinkhole activity;
- All other acts of God and acts of nature.
Damage of this kind is properly addressed through the owner’s homeowner’s, flood, or property insurance, and not through this warranty.
5. Tile, Coping & Decking (One-Year Workmanship Warranty)
Tile, coping, and decking installed under contract are warranted against defects in LIV Pools’ workmanship for one (1) year from the date of substantial completion. Any claim must be reported to LIV Pools in writing within that one-year period. Claims not reported in writing within one year are excluded. Natural variation, efflorescence, tile expansion, hairline cracks, fading, chalking, and the items in Sections 3, 4, and 8 are not covered.
6. Equipment & Accessories (Manufacturer Warranty)
Pumps, heaters and heat pumps, automation and wireless controllers, lighting, cleaning equipment, chlorinators/salt systems, alarms, and other installed equipment are warranted by their respective manufacturers. LIV Pools does not warrant, expressly or impliedly, third-party manufactured equipment, but upon reasonable request will endeavor to assign to the owner the customary manufacturer warranties and assist the owner in facilitating a manufacturer claim.
7. Non-Transferability & New-Construction / Builder Homes
All warranties are personal to the original owner and are non-transferable. The warranties described on this website and in the Customer Contract do not run with the land and do not transfer to any subsequent purchaser, owner, or occupant of the property. Upon a sale or transfer of the property, the warranties terminate, except as expressly provided below.
New-construction exception (honoring the first homeowner). Where LIV Pools installs a pool for a developer, builder, or general contractor as part of a new-construction, production, or speculative home — that is, where the party contracting with LIV Pools is not the intended end occupant — the applicable LIV Pools warranties are extended for the benefit of the first owner-occupant of the completed residence (the first retail purchaser who takes title from the developer or builder), beginning on the date of substantial completion of the pool. Thereafter, the warranties remain non-transferable and do not extend to any subsequent purchaser or owner. This exception applies only to the first homeowner, only where LIV Pools has been paid in full, and does not extend or restart any warranty period (each warranty runs from the original date of substantial completion).
8. General Exclusions
In addition to the exclusions stated above, no warranty covers:
- Damage from the use, abuse, or neglect of the owner, or the owner’s failure to provide proper maintenance or to promptly report a needed repair;
- Damage caused by improper chemical maintenance or improper water balance, including etching, pitting, scaling, staining, and discoloration of the finish;
- Defects or imperfections inherent in the materials used — such as marcite and deck discoloration, hairline cracks, tile expansion, efflorescence, shrinkage, fading, chalking, color and grain variation, and similar aesthetic conditions, including variation in pool dimensions;
- Leaves, sticks, or debris that stain the pool or clog plumbing and equipment;
- Work performed, altered, or repaired by anyone other than LIV Pools or its authorized subcontractors;
- Owner-supplied materials or equipment;
- Mold and mold-related conditions (the owner assumes all risk relating to mold);
- Damage to landscaping, irrigation, sod, hardscape, utilities, or other improvements outside the scope of work;
- Items covered by a manufacturer’s warranty or by the owner’s insurance; and
- Any item not expressly warranted.
9. Conditions to Coverage
All warranties are expressly conditioned upon all of the following:
- The owner has paid LIV Pools in full under the Customer Contract and is not otherwise in breach;
- The pool has been properly maintained, including maintaining proper water balance per the manufacturer’s start-up and care instructions;
- The pool water is tested weekly and professionally tested monthly by a reputable service, with records retained for reference; and
- The owner has not abused, altered, or neglected the pool, finish, equipment, or surrounding work.
Failure to maintain proper water chemistry can damage and stain the finish, void the manufacturer’s warranty, and void coverage under these terms.
10. How to Make a Warranty Claim
Upon discovering a condition the owner believes is covered, the owner must promptly give written notice to LIV Pools describing the defect, and must allow LIV Pools (and its subcontractors, suppliers, and vendors, if requested) a reasonable opportunity and access to inspect and correct the condition. Any claim for an alleged construction defect is also subject to the notice-and-cure requirements of Chapter 558, Florida Statutes.
